Banta. <br />Divimon DireMr <br />The Colorado Rules and Regulations for Coal Mining (4,05,6) have been modified <br />to reflect recent changes in the federal regulations. As you may know, the <br />state petitioned fora grandfather clause in the federal regulations, but was <br />rejected, The new regulations require that principal and emergency spillways <br />be separated, unless they are configured as an armored open channel. <br />A number of ponds which currently route primary and emergency discharges <br />through a single, enclosed spillway are impacted by this Rule change. Ponds <br />with this type of spillway will need to be reconfigured to meet this new <br />criteria. <br />Affected permittees wi71 need to submit technical revisions to their permits <br />which incorporate•these design changes.
