Map No. 14 was revised accordingly in the <br />submittal dated July 24, 2000. <br />4. Please verify that there are no structures or resources in the proposed addition to the <br />permit area that have not already been accounted for in the Bowie No. 2 Mine permit <br />application. <br />The Division has no further concems. Jn the submittal dated July 24, 2000, BRL stated <br />that there were no new structures or renewable resources in the area of concern. <br />5. On permit page 2.05-68, it is stated that Map 23 water right codes 1, 2, 3, 4 and 5 are <br />outside the effect of mining. With the increase in the permit area from approval of TR-16, <br />ar [east some of these locations may be affected by the proposed mining. Please add a <br />discussion on permit page 2.05-68 concerning the effects of mining on the hydrologic <br />quantity and quality of the water for these water rights. <br />The Division has no further concems. In the submittal dated July 24, 2000, permit text <br />pages 2.05-68, 2.05-100, 2.05-101, 2.05-113 and 2.05-114 were revised to include the <br />five water rights locations in the affected azea. Also, BRL referenced several approved <br />permit application pages that already discuss the impact of mining on these springs. BRL <br />pointed out that the chance for impacts to these water rights would be negligible, if any, <br />since the overburden above the water rights ranges from 1,040 feet to 1,360 feet thick. <br />Finally, BRL updated pages 36 through 40 to add longwall mining references to the text <br />describing the mining technique. <br />6. /n a letter dated July 10, 2000 and faxed to BRL on the same day, the Office of Surface <br />Mining has determined that the approval of TR-16 constitutes a federal mine plan action <br />and would make the Bowie No. 2 Mine a federal mine. <br />The Division understands that the Office of Surface Mining (OSM) is in the process of <br />preparing the background material for the mine plan action and will consider the <br />Secretarial approval for this technical revision once the Division renders a proposed <br />decision. Also, because approval of this technical revision would make the Bowie No. 2 <br />Mine a federal mine, the Division will issue a findings document for its proposed <br />decision for TR-16. <br />7. Enclosed is a memo-to-ftle stating that the U.S. Forest Service had no comments on TR- <br />16. Several other public agency comment tellers were faxed to you previously. <br />
