,a
The Division has no further concerns. The mulch will be anchored as described on
page73 of Section 2.05 of Volume I of the permit application.
6. On proposed revised page 34, the discussion of the West Mine sediment ponds is placed
at the end of the page. However, this placemettl breaks up the discussion of the coal
stockpile area pond that is on page 34 and page 35. The Division suggests revising page
34 so that the discussion of the West Mine ponds does nor break up the coal stockpile
pond discussion.
The Division has no further concerns. BRL provided a revised page 34 in the submittal
dated September 13, 2001 and received at the Division on September 17, 2001.
In a letter dated August 15, 2001, the Division forwarded to BRL an August 14, 2001
letter from the Colorado Division of Water Resources. The issues in that letter are part of
the adequacy review for TR-37.
In the submittal dated September 14, 2001, BRL responded to the concems of the
Division of Water Resources (CDWR). DMG submitted BRL's response to the CDWR
for review. The Division is waiting for a reponse from the CDWR and will forward the
CDWR response to BRL as soon as we get it.
8. The SAE designs for the West Mine jan site are in Volume 8 of the permit application.
The approved designs cover the current configuration, which includes silt fence for
sediment control. /f Bowie wishes to design for a fisture reclaimed configuration that
doesn't include silt fence, please submit new SAE designs.
The Division has no further concems. BRL doesn't wish to revise the designs for now.
If you have any questions, please call me.
Sincerely,
J sep J. dash
Environmental Protection Specialist
cc: Mr. William A.
