Cattany <br />Division DirecTOr <br />Natural Resource Trustee <br />The Division of Reclamation, Mining and Safety (Division) hereby issues notice, in accordance with Title 34, <br />Article 33, Section l 16, Paragraph 4, of the Colorado Revised Statutes, that on August 2, 2007, an application to <br />revise coal mining operations at the Foidel Creek Mine was considered complete for the purposes of filing. The <br />revision was submitted by Twenrymile Coal Company. All review and comment periods as provided in the Act <br />and the Regulations initiate from this date of filing. <br />This technical revision permits the construction, operation, maintenance and reclamation of the 6-Main North <br />Minewater Storage Reservoir and associated features (including pipelines). <br />The underground coal mining operation is on land located approximately 23 miles southwest of Steamboat <br />Springs, Colorado. The permit area is further described as follows: <br />[n portions of Sections 7, 8, 9, T4N, R86W; Sections 32 and 33, T6N, R86W; Sections 23, 24, 25, 26, 27, 34, 35 <br />and 36 in TSN, R87W; and all of TSN, R86W with the exception of Sections 34, 35, and 36. <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Rattlesnake Butte, Cow <br />Creek, Dunckley, Milner, Mount Harris, and Oak Creek. <br />Because the above-referenced technical revision application would disturb additional lands to those already <br />permitted to be disturbed within the permit area or might otherwise alter previously approved permit conditions or <br />mitigation measures, we are requesting your agency's evaluation of the potential for impacts to cultural and historic <br />resources. An extract of the Surface Facilities and Freshwater Systems Map 24, Sheet 3 of 3, provided in the <br />application, is enclosed. New disturbance for the proposed reservoir is in Section 17 TSN R86W. New <br />disturbance for proposed water lines are in Sections 17, 20 and 21. The areas of the proposed disturbance have <br />been highlighted. As indicated below, the entire application is on file at the Division.
