Hox 1299 <br />Paonia, Colorado 81428 <br />RE: Technical Revision for an Incidental Boundary Change and Revised Alluvial <br />Valley Floor Designation, Orchard Valley Mine, (TR-13, File No. C-81-038) <br />Dear Karl: <br />The Division has issued a proposed decision to approve your technical revision <br />request. The revision proposes to add 9.6 acres to the permit area as an incidental <br />boundary change, and requests that the Division review the alluvial valley floor <br />designation for those areas that contain the geologic units along the North Fork of <br />the Gunnison River identified as course-grained slope outwash (pediment) deposits. <br />The request for a change in designation was based on past studies that show that <br />these deposits do not meet the geologic criteria for AVF designation. <br />The area proposed in the incidental boundary change is not an alluvial valley floor <br />under the new determination, however the Division will continue to require that the <br />mine restore the essential hydrologic function in this area. The stipulation (No.26) <br />in the AVF findings will still apply to the reclamation of the loadout. <br />Enclosed is an addendum to the findings that the Division is required to make with <br />respect to alluvial valley floor determinations. The addendum will replace the entire <br />AVF portion of the current findings. Essentially the 3 findings that the Division are <br />required to make, concP*+++*+g protection of alluvial valley floors, have not changed. <br />Please review this document and submit comments before the end of the public <br />comment period. The public notice will be published in the Delta County Independent <br />as soon as possible.
