OS-04452 Sanborn Creek Mme <br />• <br />The following snr*+mari~rs all lands, interests in lands, options, or pending bids held or made by OMI <br />for lands contiguous to the area covered by the permit. <br />Somerset Mu~irtg Company applied for and obtained Federal Coal Leaze OOG 53510, <br />effective November 1, 1992. The Lease was trarisferred to Pacific Basin Resources, a <br />Division of Oxbow Carbon & Mmerals, Inc., effective September 28, 1995. On April 1, <br />1996, Oxbow Carbon & Minerak, Inc. filed an application for modification of Federal Coal <br />Lease COG53510. The leaze modification sought to add an additional 157.55 acres on the <br />north and east boundaries of the current leaze area. Oxbow Carbon & Minerals, Inc. <br />withdrew this application January 8, 1997. Oxbow Carbon & Minerals, Inc. also filed an <br />application for right-of-way June 5, 1996 and withdrew tha[ applicauon Ottober 28, 1996. <br />On October 2, 1997, Oxbow Carbon & Minerals, Inc. filed an application for assignment of <br />Federal Coal Leaze COG53510 to OMI az its successor in interest. The lease assignment was <br />effective January 1, 1998. On October 29, 1999, an application for a leaze modification was <br />filed to add 127.79 acres on the nonh boundary of the ]ease tract. The modified lease u <br />anticipated to be approved in January 2000. No mining will occur in the modification area <br />until the modified leaze u issued to OMI. <br />On November 14, 1997, OMI filed an application for Federal Lease for an area of coal <br />reserves encompassing 3,702.8 acres and designated az the Elk Creek Lease Tract. A <br />competitive leaze sale was held on May 31, 2000 with OMI being awarded Elk Creek Tray <br />Coal Lease COG61357, az the successful bidder <br />2.03.5 -Compliance Information <br />Neither OMI, nor any subsidiary, affiliate or peaon controlled by or under common control with <br />OMI, has had a Federal or State mining permit for surface coal mining operations suspended or <br />revoked in the List five years or has ever forfeited a mining bond or similar security deposited in lieu <br />of bond. <br />OMI has received no violation notices within the three-year period preceding the permit revision <br />application. In addition, no unabated cessation orders or air or water quality violation notices have <br />been received prior to the date of application by OMI or any person who owns or controk the OMI. <br />Any changes in Section 2.03.5 occumng between the date the permit revision application u submitted <br />and approval of permit revision will be incorporated prior to final permit revision approval. <br />PR04 2.03-10 Revised August 2000 <br />
