(the 'Act"), as amended, provides that no peratit may be issued under the Act until the Mined Land Reclamation Board (the "Board') receives a performance watrnnry (or warranties) that is a written promise to comply with all applicable regturemenu of the Aa. WFiERFAS, IJa kt..~: Kam- ice.( applied for a permi[ to conduct a mining operation DEPAATMfl NATLJ~ RESOVF (the "Operator"), has ~.. (the "Operation") on certain lands in Ss.. /~?,~~~ I Counry, Colorado. These lands arc described in the permit application, as amended and supplemented, and are referred to herein as tht "Affec[cd Lands". WFIEREAS, in iu application for the permit, the Operator has agreed to be bound by all requitrmeau of the Aa and all applicable rules and regulatioru of the Boazd, as amended from time to time. W1iEREAS, the $oard has determined, in accordance with the Act, that the estimated costs of reclamation with regard to those affec[ed lands in «< Counry which are now or may become subject to the petmi[ are those amounu for a stated periods of time as se[ forth in the financial warranty, which may be amended from time co time to reflect revised estimates of said costs of reclamation. ~TA-~-E nF x'(11 nR A 11n WEIEREAS, the Operator hereby gives the Board a performance warzanry pursuant to Section 34-32-117(2) or Section 3432.5-117(2) of the Act, and herein promises the Board that it will comply with al] applicable requirements of the Act avith regard to those Affected Lands.
