~L~i/
STATE OF COLORADO
Bill Owens, Governor
DEPARTMENT OF NATURAL RESOURCES
DIVISION OF WILDLIFE ~~
AN EQUAL OPPORTUNIN EMPLOYER
Bruce McCloskey, Director
soso Broadway
Denver, Colorado 80216
Telephone: (303)297-1192.
October 31, 2005
Erica Crosby '
Environmental Protection Specialists
Division of Minerals and Geology U/
1313 Sherman St, Room 215
Denver, CO 80203
Re: Jake Kauffman & Son, Permit #M-1999-069
Ms. Crosby,
(~a

For ~Idlife-
ForPeople
i
I have reviewed the letter and CD for the Jake Kauffman & Son Pit#3 Amendment to Permit #M-199-069. The
amendment Is to add SS acres to the mining permit and change the reclamation plan from seeded pasture to water
storage.
The mining will be done in three phases. Phase I is 41 acres and neazest the Big Thompson Ponds State Wildlife
Area. The reclamation is to be seeded pasture. Phase II is 135 acres and will be the East Reservoir after
reclamation. Phase III is 3S acres and will be the West Reservoir after reclamation. The Reservoir slopes aze 3:1,
which is the minimum the Division of Wildlife would be comfortable with. The DOW insists on no negative
impacts to the water level (hydrology) of the SWA. The DOW also asks for minimal impacts to recreationists.
Restricting mining activity to daylight hours during busy small game and waterfowl seasons (September through
February) may be necessary. Disturbance to fish or fishing recreation due to lowered water levels (affecting water
quality or increased water temperature) is not acceptable. Terrestrial wildlife in the azea will disperse away from
the mining disturbance and will hopefully return after mining is complete.
The USFWS should be contacted regarding potential negative impacts to federally listed plant and animal species
and their habitat potenfially occurring on the impacted area.
The weed and reseeding plans are adequate. If you have further questions, please contact Aimee Ryel at 9870-461-
4003. Thank you for the opportunity to comment on this Permit.
Sincerely,
~~~ ~~
f~~
Scoot Hoover
Northeast Regional Manager
Cc: Leslie, Ryel, Sherman, File
DEPARTMENT OF NATURAL RESOURCES, Russell George, Exeafive Director
WILDLIFE COMMISSION, Jeffrey Crawford, Chair+ Tom Burke, Y~ce Chair • Ken Torres, Serxe~ry
Members, Robert Bray • Rids Enstrorn • Philip James • Claire O'Neal • Richard Ray • Robert Shcemakr~
Ex Officio Members, Russell George and Don AmeM
