Box 68 <br />Craig, CO 81626 <br />RE: Preliminary Adequacy Review, TR - 22 <br />Permit C-81-044 <br />Dear Mr. Johnson: <br />~P~ oF~9~ <br />i~~~:~~ <br />X876 <br />Roy Romer, <br />Governor <br />Michael B Long. <br />Division Director <br />The Division has completed the preliminary adequacy review for <br />technical revision number 22. <br />A representative of Axial Valley Ranch (Colowyo Coal Company) <br />verified that Cyprus-Empire does actually own the property shown as <br />Axial Valley Ranch property on Cyprus's Map 1, Surface Ownership. <br />Therefore retention of this road does have land owner's consent. <br />Retention of the road also complies with the designated post-mining <br />land use assuming that pond 9A-P1 is approved by the Division for <br />retention as a stock pond. <br />Pending approval of TR-21 for retention of pond 9A-P1, the Division <br />has no further concerns that need to be addressed at this time. <br />Should you have any questions, please contact me at my office. <br />Sincer , <br />Stephen F.
