EXHIBIT S -PERMANENT MAN-MADE STRUCTURES <br />The information provided in this Exhibit is intended to satisfy the requirements outlined in Section 6.4.19 of <br />the Colorado Mined Land Reclamation Board Construction Material Rules and Regulations. <br />The following permanent man-made structures are located within 200 feet of the affected land boundary <br />and are owned by others. <br />U.S. Highway 85 <br />Colorado Department of Transportation <br />E-470 Toll Road <br />E-470 Public Highway Authority <br />36" Water Line <br />Silver Peaks Metropolitan District <br />Telephone Line and Pedestals <br />Qwest, Inc. <br />Underground Electric Line <br />Colorado Department of Transportation <br />E-470 Public Highway Authority <br />E-470 Public Highway Authority commits to not mine within 200' of any structures without either providing a <br />notarized agreement or an engineering evaluation including a stability analysis showing no adverse impacts to <br />structures. Notarized agreements or slope stability analysis will be submitted, as a Technical Revision, for <br />DRMS approval prior to mining within 200' of any structure. Mining does not include regular highway <br />construction maintenance, repair or improvements consistent with the performance and operation or the E-470 <br />roads, access ramps or other operational improvements.
