Gravel by virtue of a document recorded in Book 2631 at Page 371 of the records of the Clerk and <br />Recorder of Adams County. <br />4. By virtue of this Rule and Older, Petitioner has condemned and taken all right of <br />Union Pacific Land Resources Corpo "ration, n/k/a RMB Land Corp., its successors in interest'and <br />subsequent assigns to enter upon, use or occupy the surface of the Property, or locate or <br />perpetuate surface facilities incident to the extraction of any component of the "mineral deposits <br />on the portion of the Property Interests described in Exhibit A. Except as the same may be <br />needed for subsurface support, the Petitioner is not condemning title to any mineral estate in coal <br />in, on, or under the Property (the `4riineral estate"} owned by Respondent, Union Pacific Land <br />Resources Cprporation, n/k/a RME Land Corp. ~y virtue of a Quitclaim Deed recorded in Book <br />1684 at Rage 281 of the records of the Clerk and.Recorder of Adams County. <br />5, The Petitioner shall deposit tha sum of $370,032.00 into the Registry of the Court <br />asset forth above upon Entry of this Rule and Order. The Court does hereby ORDER the Clerk of <br />the Registry, following the deposit of funds in thearnountof$370,032.00, to issue a-issue a check in <br />the•amount ofthe Deposit•plus-any prior payment into the court registry for this case that has not <br />been withdrawn, plus any accrued interest, payable to Henderson Development Company. The <br />above-described check shall be mailed to the offices of Miohae] G.
