Deserado Mine Permit Revision No. PRO1 Adequacy Review Comments December 27, 1985 I. Legal, Financial 8 Compliance Information - Rule 2.03 ~~The coal ownership discussion on page I-13 of the permit application will need to be revised to include the 3 new Lease tracts. Table I-1 will also need to be revised in similar fashion. Page I-22 of the application should be revised as necessary to include the names and addresses of the owners of record of all surface and subsurface areas within and contiguous to any part of the proposed permit area. Maps 1 8 2 of the application will need to be revised to show all surface and subsurface ownership within and contiguous to the proposed permit area. ,- Section I.E.3 of the application will need to be revised to provide a ~K~ description of the documents upon which Western Fuels bases its Legal V right to enter Federal Coal Leases C-0126669, C-8424, and C-8425. Copies of the documents should be included as Exhibits inserted at the end of Section I of the application. I'fhe permit term information presented on page I-24 of Section I and pages III-6 through III-12 of Section III of the application needs to Abe revised to state the anticipated or actual starting and termination ~idate of each phase of the underground mining activities and the ~~~ anticipated number of acres of surface lands to be affected, and the horizontal and vertical extent of proposed underground mine workings, for each phase of mining and over the total life of the permit. II. Land Use - Rules 2.04.3, 2.05.5, 8 4.16 Section II.J. of the application needs to be revised to include a description of existing environmental resources, structures, and ~ current land use within the proposed permit area and adjacent areas that may be affected or impacted by the proposed underground mining activities. III. Cultural and Historic Resources - Rules 2.04.4, 2.05.6(4) Section II.A. of the application must be revised to contain a description of any cultural and historic resources listed in the National Register of Historic Places and any known archaeological features which are located within previously unsurveyed portions of new lease areas. Based upon information presented on Map 3 of the application, it appears that the western two-thirds of Federal Coal Lease C-8424 has not been surveyed to determine the presence of sites potentially eligible for inclusion into the National Register.
