<br /> <br />Deserado Mine Permit Revision No. PRO1 <br />Adequacy Review Comments <br />December 27, 1985 <br />I. Legal, Financial 8 Compliance Information - Rule 2.03 <br />~~The coal ownership discussion on page I-13 of the permit application <br />will need to be revised to include the 3 new Lease tracts. Table I-1 <br />will also need to be revised in similar fashion. <br />Page I-22 of the application should be revised as necessary to include <br />the names and addresses of the owners of record of all surface and <br />subsurface areas within and contiguous to any part of the proposed <br />permit area. Maps 1 8 2 of the application will need to be revised to <br />show all surface and subsurface ownership within and contiguous to the <br />proposed permit area. <br />,- <br />Section I.E.3 of the application will need to be revised to provide a <br />~K~ description of the documents upon which Western Fuels bases its Legal <br />V right to enter Federal Coal Leases C-0126669, C-8424, and C-8425. <br />Copies of the documents should be included as Exhibits inserted at the <br />end of Section I of the application. <br />I'fhe permit term information presented on page I-24 of Section I and <br />pages III-6 through III-12 of Section III of the application needs to <br />Abe revised to state the anticipated or actual starting and termination <br />~idate of each phase of the underground mining activities and the <br />~~~ anticipated number of acres of surface lands to be affected, and the <br />horizontal and vertical extent of proposed underground mine workings, <br />for each phase of mining and over the total life of the permit. <br />II. Land Use - Rules 2.04.3, 2.05.5, 8 4.16 <br />Section II.J. of the application needs to be revised to include a <br />description of existing environmental resources, structures, and <br />~ current land use within the proposed permit area and adjacent areas <br />that may be affected or impacted by the proposed underground mining <br />activities. <br />III. Cultural and Historic Resources - Rules 2.04.4, 2.05.6(4) <br />Section II.A. of the application must be revised to contain a <br />description of any cultural and historic resources listed in the <br />National Register of Historic Places and any known archaeological <br />features which are located within previously unsurveyed portions of new <br />lease areas. Based upon information presented on Map 3 of the <br />application, it appears that the western two-thirds of Federal Coal <br />Lease C-8424 has not been surveyed to determine the presence of sites <br />potentially eligible for inclusion into the National Register. <br />
