<br />GROUND WATER COMPLIANCE PROTOCAL <br />1. The Division will be notified immediately of any evidence of possible non-compliance with <br />ground water permit condition(s) and a copy of the analysis of the sample showing the <br />possible non-compliant condition will be provided to the Division within 5 days of its receipt by <br />the Operator. <br />2. The initial verification sample would be taken within 2 weeks of the receipt of the analysis <br />showing the possible non-compliance. <br />3. The second verification sample would be taken within 2 weeks of the receipt of the analysis of <br />the initial verification sample, if evidence of possible non-compliance with the permit <br />condition(s) persists. <br />4. If compliance with the perrnit condition(s) is demonstrated by either of the verification samples, <br />the Division will conclude that non-compliance with the permit condition(s) has not occurred <br />and regular monitoring of the compliance well would be resumed. <br />5. If compliance with the permit condition(s) has not been demonstrated by either of the <br />verification samples, then the Division will consider the extent and nature of the non- <br />compliance and determine the enforcement action to betaken. <br />6. If evidence of the possible non-compliance persists through the second verification sample, <br />the Operator will provide to the Division, within 30 days of the receipt of analysis of the second <br />verification sample, a permit revision adequate to bring the mine into compliance with the <br />permit condition(s) that are not in compliance. <br />
