The April 18 letter memorialized the fact that Mineral Reserves, Inc. <br />("MRI") and Mobile Premix Concrete, Inc. ("Mobile Premix") would look to Western Mobile <br />Boulder, Inc. ("WMB[") to redress any damage from mining to any MRI or Mobile Premix <br />structures located on or within 200 feet of the affected land under Amendment 006. As vice <br />president of WMB[, this further confirms that WMBI agrees to reimburse MRI and Mobile <br />Premix for the same. <br />In addition, this is to confirm that Scott Gudahl is a duly authorized agent of WMBI <br />empowered to take all steps necessary to ensure the successful mining and reclamation of the <br />Lyons Project site.
