Long <br />Diririon Direulor <br />Re: Public Response to Amendment AM-03, $ayfield Pit #l, Permit M-87-038 <br />Dear Mr. Friedley, <br />This office has received your letter of public comment in response to the above-named <br />amendment application. It vas received prior to the end of the public comment period. The letter <br />asks about several issues which are under the Division's jurisdiction, and I will attempt to answer <br />those for you below. There are also numerous questions raised which refer to non-jurisdictional <br />subjects, and I will identify those below. <br />Due to the fact that you have responded to this office, through your letter of public comment, I <br />must ask you specifically about the nature of your questions. When a letter of "complaint" or <br />"objection" is received during the public comment period, the Division is obligated to set into <br />motion a different process for reviewing issues and the decision making for the application. It <br />also involves the scheduling of t~vo conferences, at which the public objector is a party, followed <br />by a final hearing, at which the Board will make a decision on the application. These take place <br />during a statutori]y extended decision period. <br />Therefore, I must know if you are simply looking to obtain detailed information about the <br />existing and amended permit, or are you actually objecting to the amendment application? <br />Please respond to me at your earliest opportunity, since I must begin to schedule any <br />necessary conferences and hearings very soon. <br />If the issues raised in your letter are not objections, may I ask you to please provide a letter <br />stating such, or that these issues are being withdrawn? If any of your issues are to be <br />considered objections, it may be beneficial to streamline them as a group by eliminating <br />those over which this Division has no authority. <br />Below, I have arranged my responses to correspond to the numbers of your questions. <br />1. Though the final land use is identified as rangeland, there is indeed a pond proposed within the <br />larger of the two amendment areas. The bond for the entire permit will be recalculated during this <br />amendment review process, and will include all reclamation tasks, for all separate land use areas. <br />
