ADMINISTRATIVE TIME DEADLINES <br />112 Regular Permit Applications <br />GENERAL POLICY: <br />• An application For a new permit or an amendment to an existing permit is not considered received until the <br />application is determined to be administratively complete by an authorized DMG representative. (See <br />existing policies on what constitutes administrative completeness.) <br />• Day one is always the day following the agency's decision that the application is administratively complete. <br />• [f a decision date falls on a holiday or weekend, the neat business day is the decision date. <br />• Complex or controversial applications always require that the decision and hearing dates be verified by <br />your supervi:cor. If the dates change, they must be re-verified <br />• Every party'to a hearing before the MLRB require a minimum 30 days notice, unless all parties agree in <br />writing to waive their right to the 30 day notice. This notice requirement includes parties to permit and <br />amendment application hearings. <br />CLARIFICATION OF DECISION AND HEARING DATES: <br />• Counting of the 20-day public comment period begins the day following the date of the last publication. <br />• The Division's decision can occur no sooner than the 31A day from the end public comment period. Day one is the <br />day aker the 20th day of the public comment period. If the comment period ends on a weekend or holiday, the <br />comment penod must be extended to the next business day. <br />• The Division must consider the application by the 90`h day following the date the application was considered <br />received. The Board must consider the application by the l20'h day following the date the application was <br />considered received. The Division or Board may extend the date for consideration by sixty days from the date of <br />the 120'" day, but only if the application is complex, for unforeseen circumstances, or signi5cant snow cover that <br />prevents a preop. inspection. <br />• If an objection to the application is submitted during the public comment period, and where the applicant has <br />submitted a change to the application that is considered by the Division to be a Technical Revision (TR} or <br />Amendment to the application, the Division must extend the time period at least 20 days if the change is a TR, and <br />45 days if the change is an amendment. in no case can the time period be extended more than 90 days from the <br />date the revision is considered received. <br />• If the Division has not received an objection to the application, and the applicant has submitted a change to the <br />application that is wnsidered by the Division to be a Technical Revision (TR) or Amendment to the application, <br />the Division may extend the time period as necessary to afford the Division the time it needs to adequately review <br />the revision. In no case may the time period be extended beyond 90 days from the date the revision is considered <br />received <br />• The informal conference is held aker the close of the public comment period. <br />• The pre-hearing conference must be held S working days prior to the Board hearing, and at least 10 days after the <br />date the Division makes its recommendation. <br />M:~rninUCS~Projassign2.doe <br />
