Long <br />Glenwood Springs, CO 81601 Drvis~on Dnetlor <br />Re: Permit Renewal Application <br />Coal Ridge No. 1 Mine (Permit No. C-84-065) <br />Dear Mr. McKennis: <br />This letter follows your June 25, 1996 request for an informal <br />conference regarding the permit renewal for the Coal Ridge No. 1 <br />Mine and our telephone conversation this morning regarding the same <br />subject. <br />Rule 2.08.5 of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining states that any valid, existing <br />permit carries the right of successive renewal upon expiration of <br />the term of the permit. The Rule further states that the Division <br />shall, upon the basis of a complete application for renewal and <br />completion of all public notice and hearing requirements, issue <br />renewal of a permit, unless it is established by a preponderance of <br />evidence and written findings by the Board that: the terms and <br />conditions of the existing permit are not being met, the mining/ <br />reclamation operation is not in compliance with the Act and Rules, <br />the renewal would substantially jeopardize the permittee's <br />continuing responsibility on existing permit areas, the operator <br />has not provided evidence that the performance bond will continue <br />in full force for the term of the requested renewal, or any <br />additional revised or updated information required by the Division <br />has not been provided. <br />You expressed a concern that the renewal of the permit at the Coal <br />Ridge No. 1 Mine would enable mining operations to recommence. <br />Under the current permit, the mine is in permanent cessation. The <br />permit renewal would not change the status of the mine, but would <br />enable the operator to continue performing required reclamation <br />activities during the ten-year liability period which follows the <br />initial reclamation of the mine. In order for the current <br />operator, NCIG Financial, to recommence mining in the Coal Ridge <br />No. 1 Mine, the operator would have to submit an application for a <br />permit revision in accordance with Rule 2.08.4. <br />
