BRL should have an agreement with <br />Oxbow prior to the DMG's notice or proposed decision for this permit revision. <br />24. Right-of--entry onto U. S. Forest Service (USES) land is contingent upon <br />satisfaction of USES stipulations and concerns, as referred to in item number 25d <br />below. <br />BRL -USES stipulations are addressed below. <br />25. The Division has already sent to BRL the adequacy review letters that we have <br />received from other agencies. These other adequacy review letters are as <br />follows: <br />a. The Office of Surface Mining (OSM) letter, dated November 1, 2000, in <br />which it was stated that PR-04 constituted a mine plan change requiring <br />Secretarial approval. OSM will issue its mine plan change decision after <br />the Division issues its proposed decision. <br />BRL - No Response Required. <br />b. The Colorado Historical Society (CHS) letter, dated October27, 2000, that <br />was sent to Sally Crum of the Grand Valley Ranger District. In a telephone <br />conversation that the Division had with Jim Green of the CHS, the Division <br />was informed that the October27, 2000 letter, although addressed to Sally <br />Crum, was also meant as a response to the Division's completeness letter <br />for PR-04. Therefore, this letter is an adequacy review letter for PR-04 <br />from the CHS. The CHS is requiring additional information for PR-04. <br />BRL -The Colorado Historical Society indicates two concerns in its letter. <br />The first concern is a request for testing of site 5DT1326. Site 5DT1326 is <br />a prehistoric campsite located in a road cut along Hubbard Creek. BRL <br />does not know the exact location of the site. Therefore, the USES should <br />compare the site's location with BRL's subsidence map, Map 27, to <br />determine if the site is outside of the projected extent of subsidence. Field <br />evaluation and testing of this site should only be required if the site will be <br />impacted by subsidence. <br />The second concern is the preservation of site 5DT1325, Reuben Dove's <br />Cave. BRL does not plan to subside or disturb the area surrounding this <br />site. Refer to Map 27, Subsidence, for a presentation of the projected <br />subsidence and its relationship to site 5DT1325. <br />The U. S. Fish & Wildlife Service (USE&WS) adequacy review letter, dated <br />December 14, 2000, in which it was stated that no further consultation with <br />the USF&WS was needed for PR-04. <br />
