III. COMMENTS -COMPLIANCE <br />Below aze comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a bond release field inspection for the Bowie No. 1 Mine. Bowie Resources had <br />requested a partial Phase One bond release for structural demolition and backfilling and <br />grading work at the West Mine portal and fan azeas and for structural demolition work at <br />the East Mine facilities azea. Representing Bowie Resources was Basil Beaz, while Henry <br />Austin represented the Office of Surface Mining. The land manager for the West Mine <br />area is the Bureau of Land Management (BLM), and was represented by Desty Dyer and <br />Danna Knox from the BLM Montrose field office. Mr. Kenneth Pavlisick, who has power <br />of attorney for his mother who owns the land upon which the East Mine facilities is <br />located, requested that he be contacted after the inspection of the West Mine so that he <br />could be present for the inspection at the East Mine. <br />The regulations require that the field inspection for evaluation of the success of the <br />reclamation work must be held within 30 days of completeness of the bond release <br />request, weather permitting. Since the bond release submittal was called complete on <br />November 18, 2002, December 18, 2002 was the last day to hold the bond release <br />inspection, weather permitting. <br />All parties, except for Mr. Pavlisick, met at the West Mine at approximately 9:15 a.m. on <br />Tuesday, December 17, 2002. Due to a snow fall of 6 to 8 inches the night before, and the <br />snow fall continuing, it was decided that the bond release inspection would have to be <br />postponed. With the snow fall, it would have been impossible to properly evaluate the <br />success of the reclamation work. All parties present at the West Mine agreed to the <br />postponement. Mr. Pavlisick was telephoned and informed of the decision. He also <br />agreed to the postponement. The bond release inspection will be rescheduled when the <br />weather conditions aze more favorable. <br />c: /word bowie 1 /insp 1202A <br />
