Cottony <br />Division Director <br />Natural Resource Trustee <br />The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 118, Paragraph 3, of <br />the Colorado Revised Statutes, that on September 2I, 2005, an application to renew an existing permit to conduct coal mining <br />operations at the Mart Mine was considered complete for the purposes of filing. All review and comment periods as provided in <br />the Colorado Surface Mining Reclamation Act and the Rules initiate from this date of filing. <br />Kerr Coal Company proposes to continue surface coal mining and/or reclamation operations on land located approximately 12 <br />miles east of Walden, Colorado. The permit area is further described as follows: <br />TSN, R78W, Portions of Section 2 <br />T9N, R78W, Portions of Sections 22, 23, 25, 26, 27, 35 <br />T9N, R79 W, Portions of Sections 28, 29 (loadout) <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Johnny Moore Mountain. <br />Ken• Coal Company has applied for renewal of the DMG permit for the Marr Mine. Mining ceased in 1993. The purposes of the <br />renewal is so that Ketr Coal Company can complete the reclamation activities for another S-year period or until final bond release <br />is obtained. No new disturbances are planned. <br />A copy of the renewal application is available for public inspection at the Jackson County Clerk and Recorder, P.O. Box 337, <br />Walden, CO 80480, and at the Division office.
