Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 118, <br />Paragraph 3, of the Colorado Revised Statutes, that on September 21, 2005, an application to renew an existing <br />permit to conduct coal mining operations at the Man• Mine was considered complete for the purposes of filing. All <br />review and comment periods as provided in the Colorado Surface Mining Reclamation Act and the Rules initiate <br />from this date of filing. <br />Kerr Coal Company proposes to continue surface coal mining and/or reclamation operations on land located <br />approximately 12 miles east of Walden, Colorado. The permit area is further described as follows: <br />TSN, R78W, Portions of Section 2 <br />T9N, R78W, Portions of Sections 22, 23, 25, 26, 27, 35 <br />T9N, R79W, Portions of Sections 28, 29 (loadout) <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Johnny Moore Mountain. <br />Kerr Coal Company has applied for renewal of the DMG permit for the Man• Mine. Mining ceased in 1993. The <br />purposes of the renewal is so that Kerr Coal Company can complete the reclamation activities for another 5-year <br />period or until final bond release is obtained. No new disturbances are planned. <br />Because the above-referenced permit renewal application would incorporate additional lands into the permit area or <br />might otherwise alter previously approved permit conditions or mitigation measures, we are requesting your <br />agency's evaluation of the potential for impacts to cultural and historic resources. <br />In accordance with the May 1991 Memorandum of Understanding (MOU) between our agencies, we must have your <br />concurrence in order to approve this proposal. We are required to make a finding that "the proposed operations will <br />not adversely affect any publicly owned park or place listed on or those places eligible for listing, as determined by <br />the SHPO, on the National Register of Historic Places, unless approved jointly by the Board and the Federal, State, <br />or local agency with jurisdiction over the park or place." Therefore, we request that you submit comments regarding <br />your concurrence with, concerns with, or objections to this proposal.
