Cattany
Division Director
Natural Resource Trustee
The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 118,
Paragraph 3, of the Colorado Revised Statutes, that on September 21, 2005, an application to renew an existing
permit to conduct coal mining operations at the Man• Mine was considered complete for the purposes of filing. All
review and comment periods as provided in the Colorado Surface Mining Reclamation Act and the Rules initiate
from this date of filing.
Kerr Coal Company proposes to continue surface coal mining and/or reclamation operations on land located
approximately 12 miles east of Walden, Colorado. The permit area is further described as follows:
TSN, R78W, Portions of Section 2
T9N, R78W, Portions of Sections 22, 23, 25, 26, 27, 35
T9N, R79W, Portions of Sections 28, 29 (loadout)
The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Johnny Moore Mountain.
Kerr Coal Company has applied for renewal of the DMG permit for the Man• Mine. Mining ceased in 1993. The
purposes of the renewal is so that Kerr Coal Company can complete the reclamation activities for another 5-year
period or until final bond release is obtained. No new disturbances are planned.
Because the above-referenced permit renewal application would incorporate additional lands into the permit area or
might otherwise alter previously approved permit conditions or mitigation measures, we are requesting your
agency's evaluation of the potential for impacts to cultural and historic resources.
In accordance with the May 1991 Memorandum of Understanding (MOU) between our agencies, we must have your
concurrence in order to approve this proposal. We are required to make a finding that "the proposed operations will
not adversely affect any publicly owned park or place listed on or those places eligible for listing, as determined by
the SHPO, on the National Register of Historic Places, unless approved jointly by the Board and the Federal, State,
or local agency with jurisdiction over the park or place." Therefore, we request that you submit comments regarding
your concurrence with, concerns with, or objections to this proposal. In order that we may comply with regulatory
Office of Office of Colorado
Mined Land Reclamation Active and InaRive Mines Geologiral Survey
