<br /> <br />is achievable at least through treatment. However, the relative contribution from each source to <br />each proposed monitoring point has not been shown or modeled. For instance, it has not been <br />stated whether "Pre-Cambrian" water, which was collected at the weathering surface ofpyrite- <br />bearing rock, will contribute enough poor-quality water to any single point to compromise pre- <br />mining water quality. Without such an exercise the future water quality cannot be predicted. <br />That fact notwithstanding, it is not evident why the Division wants to know, in any detail, what <br />water quality will be like because it remains a matter of law that the operator must meet the <br />requirements of the Safe Drinking Water Act and the Colorado Groundwater Protection Act. <br />That key response portions of TR-026 are experimental in nature does not preclude meeting the <br />requirements of those acts. <br />I shall look forward to meeting with the operator to discuss the terms of TR-026. <br />cc: Jim Stevens <br />
