York-Feirn <br />Colorado Mined Land Reclamation Division <br />1313 Sherman Street <br />Denver, CO 80203 <br />Dear Mr. York-Feirn, <br />999 <br />PHONE 2dT~1092 <br />Re: Moffat Limestone Company <br />Permit No. M-82-141 (CN-O1) <br />Darryl Steele and I have carefully reviewed the letter of 4-21-92 to Carl <br />Mount from David Bray, Acting Area Manager for the Little Snake Resource <br />Area of the BLM. This letter contains several proposed "Special Stipulations" <br />for our 112 Juniper Quarry Permit. <br />We are in agreement with all of these proposed stipulations except No. 2. <br />This would effectively limit mine operations to seven months per year in <br />o der to protect critical mule deer winter range. <br />Our position is that such a stipulation would seriously restrict our ability <br />to meet our contractual obligations to supply limestone to the Electrical <br />Generating Plant in Craig and to other customers. As you know, we normally <br />cease operations during the period of extreme winter and snow conditions, <br />but vigorously request that such closures not be made mandatory. <br />No. 8 is a recitation of Reclamation Performance Standards. We agree that <br />these are good and proper guidelines and accept them as such. We certainly <br />intend to consult with BLM about reclamation procedures. However, we <br />recognise that our ultimate responsibilities are to the Mined Land Recla- <br />mation Division for performing such reclamation work. <br />The BLM bond recommendation is fora $20,000 bond or a rate of $2,000 per <br />acre. Please keep in mind that our Permit Application states that recla- <br />mation will be carried out concurrently with mining operations, and that <br />there will not be more than 10 acres of unreclaimed mined lands an any <br />one time unless special arrangements have been made with the Division. <br />Darryl Steele is currently trying to make arrangements for an <br />archeaology survey of the permit area.
