Re: Incompleteness Letter, Phase III Bond Release Request, Colorado Yampa Coal Company,
Eckman Park Mine (Mine 2), Permit No. C-81-071, Bond Release Request No. SL-06
Dear Mr. Mills:
The Division received Bond Release Request No. SL-06 for the Mine 2 portion of the Eckman Park
Mine complex on September 5, 1997. The Division has found this application incomplete for the
following reasons:
1. Rule 3.03.2(1)(a) states that the public notice regarding submittal of the application must
contain a notification of the precise location of the land affected. While the copy of the public
notice provided by CYCC stated that Mine 2 is located approximately 23 miles Southwest of
Steamboat Springs, and included a map both outlining the Eckman Pazk permit boundary and
locating generally the Mine 2 area, this should be supplemented with a legal description. We
recommend a format similar to the following:
Portions of Sections 19, 20, and 30, TSN, R86W; Portions of Sections 24, 25, and 36, TSN,~
R87W; 6th P.M.
2. The public notice did not identify the date the Eckman Park permit was approved (Rule
3.03.2(l)(b)).
3. The public notice did not identify the type of bond on file (corporate surety, letter of credit, etc.)
at the Division for the Eckman Park permit, or the current total amount of bond held by the
Division for the Eckman Park permit (Rule 3.03.2(I)(b)).
4. Other than to say "CYCC is requesting final release of 477.4 acres of reclamation which was
completed between 1980 and 1980 in compliance with the approved reclamation plan," the
public notice did not describe the type of reclamation work performed. We recommend a
description similar [o the following, as applicable:
