999 <br />BOND RELEASE REQUEST <br />The Rockcastle Company ("Rodccastle"); c/o Dean Massey; Parcel, Mauro, Hultin <br />and Spaanstra; 1801 California Street Suite 3600; Denver, CO. 80202, has <br />submitted a request to the Colorado Mined Land Reclamation Division for <br />partial bond release and bond reduction for the Grassy Gap Mine. <br />Rockcastle was granted a mining and reclamation permit for the Grassy Gap Mine <br />(Permit No. C-81-039) on April 23, 1985 under the Colorado Surface Coal Mining <br />Reclamation Act (the "Act"), 434-33-101, et seq., C.R.S. The Grassy Gap <br />Mine's precise legal description follows:- r <br />Section 20: E 1/2 SE 1/2, E 1/2 NW 1/4 SE 1/4, E 1/2 SW 1/4 <br />SE 1/4 <br />Section 21: W 1/2 SW 1/4 <br />Section 28: W 1/2 NW i/4 <br />Section 29: E 1/2 NW 1/4, NE 1/4, S 1/2 <br />Section 31: E 1/2 SE 1/4 NE 1/4, NE 1/4 NE 1/4 <br />Section 32: NW 1/2 <br />All Sections are located in Township 5N, Range 87W of the 6th Prime Meridian. <br />Rockcastle is requesting Phase I and Phase II Bond Release, as well as <br />additional bond reduction for reclamation performed at the site. Bond release <br />and reduction activities are being requested in conjunction with completion of <br />reclamation activities at the Pit No. 4, 5 and 6 areas. The current bond <br />amount is 3572,000 pursuant to a December 14, 1989, order of the CMLRB. <br />Rock castle hereby requests release of 5522,000 of its performance bond <br />pursuant to 434-33-125, C.R.S. Rock castle is requesting Phase I bond release <br />for 337 acres reclaimed between 1979 and 1990. This includes the areas <br />associated with mining Pits No. 1, 2, 3, 4, 5 and 6. In addition, Rock castle <br />requests Phase II bond release for 297 acres reclaimed between 1979 and 1984. <br />The Phase II bond release excludes revegetation work performed at Pit 4 and <br />the adjacent shop area during 1990. <br />Bond release/reduction inspections will be performed by the Colorado Mined <br />Land Reclamation Division (CMLRD) on a monthly basis between August and <br />November, 1990. On the basis of these inspections, CMLRD may release <br />liability and monies held under the bond.
