<br />Notice of Proposed Decision <br />The Colorado Division of Minerals and Geology has issued a proposed decision to partially approve <br />Phase I Bond Release Application No. SL-Ol for the Marr Mine, Permit No. C-80-006. The mine <br />is operated by Kerr Coal Company under the provisions of the Colorado Surface Coal Mining <br />Reclamation Act of 1979. The bond release application was submitted by Kerr Coal Company on <br />April 18, 1994. The Division proposes to release $521,517 fora 48-acre parcel known as Pit 1, <br />located in the S'k of Section 26, T9N, R78W, in Jackson County. The Division has determined that <br />backfilling, regrading, and drainage control have been successfully completed in this area in <br />accordance with approved reclamation plans. <br />Copies of the proposed decision are available for review at the Colorado Division of Minerals and <br />Geology office, 1313 Sherman Street, Room 215, Denver, Colorado 80203; and at the office of the <br />Jackson County Clerk and Recorder. <br />Any person who has an interest which is or may be adversely affected may request an adjudicatory <br />hearing regarding this proposed decision.
