STATE OF COLORADO
DIVISION OF RECLAMATION, MINING AND SAFETY
Department of Natural Resources
7373 Sherman St., Room 215
Denver, Colorado 80203
Phone: (303) 866-3567
FAX: (303) 832-0106
31 August 2007
Mc Kurtis Blunt
Colowyo Coal Company, LP
5731 State Highway 13
Meeker, CO 81641
Re: Colowyo Mine C-1981-019
Permit Revision 02 Stipulations 5 and 6
Dear Mr. Blunt:
COLORADO
DIVISION OF
RECLAMATION
MINING
- &-
SAFETY
Bill Ritter, )r.
Governor
Harris D. Sherman
Executive Director
Ronald W. Cattany
Division Director
Natural Resource Trustee
The Division has received and proposed a decision to approve your submittal of Minor
Revision 88 and has received your 20 July 2007 response to Stipulation 5 (a response to
the Division's 21 June 2007 Letter). Both of these submittals are in regazds to the
hydrologic monitoring plan at the Colowyo Mine. Based on this correspondence, the
Division has the following comments.
Colowyo has requested a 60-day extension for the submittal of a revision to
comply with Stipulation 5 regarding alluvial monitoring wells A7 and A8
until 19 October 2007. The requested extension will give Colowyo and the
Division additional time to work out the issues associated with the stipulation.
The Division agrees with and accepts the requested extension.
2. Based on Colowyo's submittal of Minor Revision 88 and the 20 July 2007
response letter to Stipulation 5, the Division has reviewed the currently
approved hydrologic monitoring plan, as submitted in Permit Revision 02, in
its entirety (including both surface and ground water monitoring
requirements). The Division's review of the entire hydrologic monitoring
plan was deemed necessary due to the interrelated nature of stream and
alluvial groundwater and the requirements of Stipulations 5 and 6. The
review of the hydrologic monitoring plan coincided with the adequacy review
for Permit Renewal O5, which is ongoing, and the Division has the following
questions and comments.
The Division is required by Rules 2.05.6(3) and 4.05.13 to establish a
hydrologic monitoring program that is necessary and appropriate to determine
the impacts of mining to ensure the rights of current users are protected, and
Office of Office of
Mined Land Reclamation Denver Grand )unction Durango Active and Inactive Mines
