Mr. Jon Kubic
Colorado Department of Public Health & Environment
Water Quality Control Division
4300 Cherry Creek Drive South
Denver, CO 80222-1530
Re: Minor Modification to CDPS Permit # CO-0000132, Outfall 011
Dear Mr. Kubic:
As we had discussed during our telephone conversations last week, measurements of a
borehole recently completed into Oxbow Mining, Inc.'s ("Oxbow") Sanborn Creek Mine
have indicated that the water level is rising in the mine. This water is located down-dip
(below) in the mined panel where Oxbow's longwall mining equipment was idled and
sealed in the mine due to a spontaneous coal combustion event in late January 1999.
As you know, in February approximately 88 acre-feet of water was pumped from the
North Fork of the Gunnison River into the mined longwall panel, covering the suspected
location of the combustion, but well below the elevation of the equipment. Other inflow
is apparently occurring at a rate of approximately 200 gpm. With the longwall equipment
being threatened by the rising water levels, Oxbow plans to begin pumping from the
mine through the original water infusion borehole and discharge it through a new pond
located along the river in NWi/4, SW1/4 Section 11, T13S, R90W, Sixth P.M.
Per your suggestion, Oxbow requests a minor modification to Permit # CO-0000132 to
discharge the mine water through the temporarily relocated Outfall 011. Oxbow will
utilize the new pond to treat the mine water, if necessary, and will discharge the water in
compliance with all parameters required for Outfall 011. After the Sanborn Creek Mine
has been rehabilitated, pumping from the in-mine sump to the current discharge point
location will be resumed. The temporary pumping location will then be discontinued.
So that Oxbow can proceed with the necessary CDMG permitting process, please
provide a letter to Oxbow today if possible, indicating your approval of this minor
modification request. Please call me should you have questions.
Sincerely,
~~~uU,~~
Kathleen G. Welt,
Environmental Supervisor
cc: Tom Anderson
Dan Hernandez, CDMG
P. O.
