Long <br />Divlsmn Direcor <br />This letter, in accordance with Rule 3.03.2(5)(a) of the Rules and Regulations of the Colorado <br />Mined Land Reclamation Board for Coal Mining, is to inform you that the Division of Minerals and <br />Geology has issued a proposed decision to approve Bond Release Application No. 2 (SL-2) for the <br />Golden Eagle Mine. This decision will be published in the Chronicle -News, as soon as possible. <br />Publication of the notice initiates a thirty (30) day public comment period. If, within thirty days, <br />there are no requests for an adjudicatory hearing, the decision will become final. <br />This bond release consists of two parts; a release of liability for lands classified with apost-mining <br />land use of industrial and a release of liability of lands south of Highways 12 which overlay <br />underground workings. Excluded from liability release are those areas of disturbance wh'sch are <br />subject to the 10-year revegetation liability period. The Bleeder Return is specifically excluded from <br />the industrial land use por[ion of this bond release request. Industrial land use areas are located in <br />Sections 28, 29, 32, and 33 of T33S, R67W. <br />As an interested party, you have the right to an adjudicatory hearing as outlined under Rule <br />3.03.2(6) of the Rules and Regulations. The request for an adjudicatory hearing must be written and <br />state with specificity the reasons why the hearing is requested.
