Rule 4.09.1(1) All excess spoil shall be transported to and placed in designated disposal areas <br />within a permit area, if disposal areas are authorized for such purposes in the approved permit <br />application in accordance with 4.09. The spoil shall be placed in a controlled manner to: <br />The application is in compliance with this rule. Designated disposal azeas, shown on Map 23A, are <br />within the (proposed) permit azea. <br />Rule 4.09.1(1)(a) Minimize the adverse effects ofleachate and surface water runofffrom the fill on <br />surface and ground waters; <br />A determination of compliance is deferred to Kent. <br />Rule 4.09.1(1)(b) Comply with the effluent limitations of 4.05.2; <br />A determination of compliance is deferred to Kent. <br />Rule 4.09.1(1)(c) Ensure stability of thefrll; and <br />Some modification is recommended. See below. <br />Rule 4.09.1(1)(d) Ensure that the land mass designated as the disposal area is suitable for <br />reclamation and revegetation compatible with the natural surroundings. <br />The application is in compliance with this rule. <br />Rule 4.09.1(2) The fill shall be designed using recognized professional standards, certified by a <br />registered professional engineer, and approved by the Division. <br />The application is in compliance with this rule. <br />Rule 4.09.1(3) See the rules for the text of this rote. Alternative specifications were not submitted. <br />Rule 4.09.1(4) All vegetation and organic materials shall be removed from the disposal area and the <br />topsoil shall be removed, segregated, and stored or replaced under 4.06. If approved by the <br />Division, organic material may be used as mulch or may be included in the topsoil to control <br />erosion, promote growth of vegetation, or increase moisture retention of the soil. <br />Removal is described on page 11 (23-1-01 1 05-200). Topsoil handling is shown on Map 28B. A <br />suggested comment to the applicant is: Please designate the topsoil piles (alpha or numeric or <br />combination). Please include the quantity of topsoil to be removed from each of the footprints <br />of the spoil piles, and to what pile it is to be stored (and returned). Rule 4.09.1(4) <br />
