A. On December 15 , Board or Division of the Col ("the state") granted to County of La Plata ("Permittee") permit number suant to which Permittee has operation in the County of RECITALS 19 77 the Mined Land Rec:.amation ~rado Department of Natural Resources La Plata Count and State of Colora o ,TT--446 ("the permit:") pur- been conducting a surface mining La Plata State of (;olorado. B. Permittee wishes to assign the permit to OREN 12pgFRT F MARION CHIQUITR SPIELERS of La Plata County, State of Colorado as successor operator ("suc- cessor") and successor wishes to become successor permit tee under the permit. C. Successor understands that the reclamation plan ("the plan") required by the permit and by applicable state ls~ws and regulations has not been completed and is willing to as:~ume full responsibility for the completion of the plan. II. AA^.RF~Ti Permittee and successor hereby agree, for their owri benefit and for the benefit of the state, such agreements to be effective ipSO facto upon the approval by the state oP the transfer of the permit from Permittee to successor, as follows: 1. Successor has inspected the mining and reclamation opera- tions to its entire satisfaction and is fully aware of t:he con- dition thereof. Successor understands and accepts all of the con- ditions of the permit. ~ - 2. Successor will complete the reclamation plan, s.nd hereby assumes liability for completing such plan as to all areas hereto- fore disturbed as well as to all areas hereafter distur~~ed. Suc- cessor will perform alI of the obligations of the permit tee under the permit which have not heretofore been performed by F~ermittee. 3. Successor hereby tenders to the state its attached reclama- tion bond* with surety therein described, which is to be~ substituted for the bond and surety heretofore filed by the permitte~e effective upon the release of the latter bond and surety. * Attach executed reclamation bond.
