Walche~ <br />E.ecuuve DireUOr <br />Micnacl s. ~~~g <br />Dwision D~reaor <br />The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 118, <br />Pazagraph 3, of the Colorado Revised Statutes, that on October 23, 2000, an application to revise coal mining <br />operations at the Bowie No. 2 Mine was considered complete for the purposes of filing. All review and comment <br />periods as provided in the Act and the Regulations initiate from this date of filing. <br />Approval of this permit revision would revise the current mine plan at the Bowie No. 2 Mine. The operator is <br />proposing to incorporate into the mine plan the longwall and room and pillar mining of the D seam, for an area that <br />is within the Uon Point Tract Federal Coal Lease COC-61209 and for a much smaller area on the east side of the <br />present permit boundary. The proposed mine plan anticipates mining into the first quarter of 2005 at the current <br />rate of 5 million tons per year. This mine plan change does not include the room and pillar mining for the area <br />within Federal Coal Lease COC-61209 that is under Terror Creek, by which the operator would be able to access <br />the B seam coal at the Bowie No. l Mine. That mine plan change is anticipated to be submitted later. <br />This permit revision would incorporate 1751 additional surface acres into the existing permit area, 1632 acres of <br />which are federal and 1 19 acres of which are private. Federal mineral acreage would increase by 171 I acres while <br />private mineral acreage would increase by 40 acres. Bowie Resources is negotiating for the remaining federal coal <br />and some private coal on the east side of the permit area. There will not be any new surface disturbance associated <br />with this revision. <br />Bowie Resources Ltd. has referenced the Federal mining lease and/or Federal Surface access agreement COC- <br />61209 in this application as a document upon which they base their legal right to enter for most of the coal. The <br />Division has received written verification from BLM that the lease and/or agreement COC-61209 has been issued <br />and that final BLM/federal agency lease/agreement approval has been granted. <br />Bowie Resources has also referenced an unnamed federal lease in its statement that Bowie Resources is <br />negotiating with Oxbow Carbon and Minerals to obtain Oxbow's fee and Federal Coal in order to mine coal at the <br />east end of longwall panels D-6, D-7 and D-8. The Division is requesting that, when final, BLM provide written <br />verification that Bowie Resources has obtained the right to enter these additional federal lands outside of Federal <br />Coal Lease COC-61209. <br />The Underground coal mining operation is on land located approximately 5 miles northeast of Paonia, Colorado. <br />The permit area is further described as follows: <br />
