Long. <br />Drv~s~on Director <br />DATE: May 11, 1992 <br />T0: Christine Johnston <br />FROM: David Berry ~ <br />RE: Permit Boundary Change Request, Laboratory Facility Installation, <br />Mountain Coal Company, Permit No. C-80-007 <br />I have reviewed the FAX submittal received from Mountain Coal Company dated <br />May 7, 1992. The proposal requests the removal of approximately 0.2 acres <br />from the Mountain Coal Company permit area, to allow the construction of a <br />separately owned and operated commercial water quality laboratory. It is my <br />understanding that the laboratory will operate indefinitely, and that the <br />local government authorities have approved the installation. It is also my <br />understanding that the installation will occur on the existing roadway and <br />shoulder, and will in no way affect the drainage control or other facilities <br />used by Mountain Coal Company. I assume that the laboratory and associated <br />roadway will be retained, regardless of the operation of the West Elk Mine; <br />therefore, the small length of road which would have been reclaimed by <br />Mountain Coal Company will no longer require reclamation. <br />Based on the above factors, I recommend that this submittal be processed as a <br />technical revision, and more specifically, as an incidental boundary change. <br />This submittal cannot be processed as a minor revision because it involves a <br />permit boundary change. <br />The submittal must include proof of local government approval for the <br />laboratory construction, and it must include appropriate maps which show the <br />revised permit boundary. I also strongly recommend a provision that if the <br />laboratory moves or becomes non-operational during the life of the <br />West Elk Mine, then Mountain Coal Company will again assume responsibility for <br />the area. It is imperative that this process does not result in our loss of a <br />reclamation commitment for the road section, if the laboratory does not remain <br />long term. <br />DAB/eke <br />cc: Steven Renner, MLRD <br />3025E <br />
