STATE OF COLORADO
DIVISION OF RECLAMATION, MINING AND SAFETY
Department of Natural Resources
1313 Sherman St, Room 215
Denver, Colorado 80203
Phone: (303) 866-3567
FAx: (303) 832-8106
June 1.2007
Jerry Nettleton
Twentymile Coal Company
29515 Routt County Road No. 27
Oak Creek, CO 80467
Re: Foidel Creek Mine (Permit No. C-1982-056)
Minor Revision No. 07-216 (MR- 216)
Technical Adequacy
Dear Mr. Nettleton:
COLORADO
DIVISION OF
RECLAMATION
MINING
-&-
SAF ETY
Bill Ritter, Jr.
Governor
Harris D. Sherman
Enecutive DlfeClor
Ronald W. Cattany
Division Director
Natural Resource Trustee
The staff of the Division of Reclamation, Mining and Safety (Division) found the subject application complete
on June 1, 2007. Please address the following technical adequacy items that relate to the application.
Item 1. Please correct the lack of continuity from the revised page 2.05-79.1 of 05/28/07 and the unchanged page
2.05-79 of 02!27/07 (TR07-59). It appears that the last line on page 2.05-79 and the discussions at the top of the
current page 2.05-79.1 of 03/26/07 (TR07-59) have been omitted.
Item 2. The current page 2.05-101 dated 04/25/06 (MR06-207) is programmed for revision under MR07-215
still in process. The current and TR07-215 pages 2.05-I01 are identical. However, page 2.05-I OI of this
application includes text that continues onto pages 2.05-102 and 2.05-103 that contain information with regard
to Washplants I and 1l that is the subject of TR07-60, still in progress. Thus the pages of this application include
unapproved text that is appropriate to the technical revision. There appears to be no technical adequacy issue at
this time with the pages once TR07-60 has final approval. Please request a stay of decision on this (MR07-216)
application to provide the Division ten days after final approval of TR07-60, or revamp the contents of the
applications to time schedules and levels of approvals.
Item 3. In a similar over-ride, Map 24 Sheet 3 of 3 revises a version of MR07-215 (still in process). However,
the areas are different and both are of MR level approvals.
Item 4. The application included a reclamation cost estimate of $10,480. The Division will also estimate the
cost of reclamation work. The estimates will be coordinated prior to a decision on the application.
An advance copy of this letter is being provided to you by e-mail. The current due date for a decision on this
application is June I I, 2007. Please request an extension to the due date for a decision on this minor revision
application so as to provide the Division with ten days after receipt of a response to this adequacy letter or 10 days
after final approval of TR07-60, whichever is later. Please contact me ifyou have any questions.
Yours truly,
Byron Walker
Environmental Protection Specialist
t t t~7~ce b~t n c t v, v,- r ~o<-wo Office of
Mined rand ReFiahi~un\My Documents\Foidel Crcmk#~Rst~ibl~t2d 6 anleq~cy letter.doc Active and Inactive Mines
