You letter <br />mentioned several concerns and requested that we fo Huard additional <br />information. We were not able to respond sooner since the proof of <br />publication notice you requested was not received until December 18, 1987. <br />The following is our response to each of the concerns raised in your letter. <br />A. You indicated that the permittee's proof of publication was received more <br />than 30 ddys after the newspaper publication. We agree, but note that it <br />is not uncommon fora newspaper to take 4-6 weeks to send an affidavit. <br />For this reason we subscribe to most of the local newspapers so we can <br />check the notices. <br />B. Documentation that surface owners were notified of our site inspection <br />was not provided. Apparently we neglected to inform the land owners of <br />our inspection. We did, however, send them a letter requesting comment <br />which I have enclosed. <br />C. You pointed out a typo in the rule we cited in our decision. Thank you <br />for bringing this to our attention. <br />D. You indicated that the permittee and other parties were not notified of <br />the proposed decision within the required 30 ddys of the inspection. <br />This is correct but the operator waived his right to a decision since we <br />needed to publish the notice for the loadout (see enclosed letter). <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 Tel.
