EXHIBIT D -MINING PLAN <br />The Sunnyside Mine is an underground hazdrock mining operation located in San Juan <br />County. The operation consists of the following distinct azeas: the Mayflower Mill and <br />Tailings Ponds area, the American Tunnel, the Terry Tunnel and the Lake <br />Emma/Sunnyside Basin area. Operation ceased in 1991 and the areas listed above have <br />been in fmal reclamation status since 1996 when Sunnyside entered into a voluntary <br />Consent Decree Agreement with CDPHE-WQCD to address their concerns with using <br />bulkheads in the MLR Permit reclamation plan to address mine drainage. <br />Sunnyside has met the requirements of the Consent Decree and is eligible for release <br />based on the terms of a recent Amendment to the Consent Decree and the corresponding <br />analysis required for release. Under this Amendment to the Consent Decree, Sunnyside <br />entered into a series of agreements whereas; <br />- the American Tunnel water treatment plant and American Tunnel CDPS <br />permit was deeded to Gold King for their use as an off-site treatment facility <br />permitted by WQCD. <br />- Sunnyside funds the plugging of two draining adits by their respective owners. <br />- Sunnyside implements two additional remediation projects on azeas owned by <br />Sunnyside. <br />This MLR Permit Amendment submittal affects only the azea know as the American <br />Tunnel area with its purpose being to change the Post Mining Land Use (PMLU) to <br />reflect the long term usage planned for the area based on the agreements ~i'~ssed-ctbeue. <br />American Tunnel Area <br />The Amendment submittal proposes to change the Post Mining Land Use (PMLU) for the <br />American Tunnel area from a combination of industrial and rangeland to industrial. <br />Through an agreement complementing an Amendment to Sunnyside's Consent Decree <br />Agreement with CDPHE-WQCD, the existing water treatment system and corresponding <br />water rights have been deeded to the owner of the property (Gold King). Gold King's <br />intention is to operate the water treatment plant under a CDPS permit that was transferred <br />from Sunnyside to Gold King and to use the other buildings also deeded to Gold King for <br />storage and office facilities (see attached letter). The industrial PMLU classification <br />recognizes this intended use of the property. <br />The remaining property, currently owned by Sunnyside, within the permit area, Herbert <br />Placer, will be deeded to San Juan Corp. along with two unpatented mill-site claims <br />(Bridge and Gladstone) upon Sunnyside's release from the Consent Decree. The quonset <br />building and access roads within this pazcel akeady have a PMLU of industrial. The <br />settling ponds will be leased back to Gold King through a separate agreement between <br />D-1 <br />
