LOnG <br />Dmniun Dvecmr <br />The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, <br />Section 1 l6, Paragraph 4, of the Colorado Revised Statutes, that on November l7. 1997, an application <br />to revise coal mining operations at the Hayden Gulch Loadout was considered complete for the purposes <br />of filing. The revision was submitted by Hayden Gulch Terminal, Inc.. All review and comment periods <br />as provided in the Act and the Regulations initiate from this date of filing. <br />The applicant proposes to extend for 5 years the existing, valid permit for conducting surface coal mining <br />and reclamation operations at the Hayden Gulch Loadout. No actual mining will be conducted under this <br />permit as this is a coal stockpile/loadout facility and railroad spur. The permit area is located <br />approximately 2 miles southeast of Hayden in portions of: E1/2 Sec. 10, W l/2 Sec. l4, El/2E1l2 Sec. l5, <br />NE1/4 Sec. 22, NW 1/4NW 1/4 Sec. 23, Township 6 North, Range 88 West of the 6th P.M. The location <br />can be found on USGS 7.5 tttinute Quadrangle map of Mount Harris. <br />Because the above-referenced permit renewal application would alter previously approved permit <br />conditions or mitigation measures, we are requesting your agency's evaluation of the potential for impacts <br />to cultural and historic resources. <br />In accordance with the May 1991 Memorandum of Understanding (MOU) between our agencies, we must <br />have your concurrence in order to approve this proposal. We are required to make a t7nding that "the <br />proposed operations will not adversely affect any publicly owned park or place listed on or those places <br />eligible for listing, as determined by the SHPO, on the National Register of Historic Places, unless <br />approved jointly by the Board and the Federal, State, or local agency with jurisdiction over the park or <br />place."
