The Division's letter, dated January 14, 2000, indicated that. "The pond G and pond B <br />stage/storage diagrams are legible and were signed and certified by the surveyor. " Both of <br />these diagrams required further review once the Division received additional information sent <br />from Montgomery Watson under sepazate cover. <br />On January 7, 2000, Twentymile Coal Company submitted the hydrologic evaluations for Pond <br />B and Pond G. Twentymile Coal Company stated that the pond B evaluation can be inserted into <br />Exhibit 8J, and the Pond G drawing replaces the existing stage-storage in Exhibit 8J. A recent <br />survey was conducted by TCC and the top of riser, orifices on riser, and emergency spillway <br />elevations were different than reported by Epp. The design used the survey data provided by <br />TCC and i[ shows the pond is adequately sized for the design event. Twentymile Coal Company <br />explained that the pond was designed and constructed to accommodate the worst case runoff <br />from the adjacent CYCC's surface mine, which is reclaimed. <br />Afrer review of the materials submitted by Twentymile Coal Company on January 7, 2000, the <br />Division finds that all that remains for pond B is an as-built P.E. certification which states that <br />pond B was built in accordance with the rules and the design as presented in Exhibit 8F. <br />Similazly, pond G also requires an as-built P.E. certification stating that the pond was built in <br />accordance with the Rules and the design as presented in Exhibit 8J. <br />~62b) The Division's original, Mazch 2, 1998 question, asked, <br />Plate 1 titled Sedimentation Ponds, Energy Mines No. l and No. 2 and Eckman Park needs to be <br />properly labeled to indicate it is part of the Twentymile permit # C-82-0~6 and to which exhibit <br />it belongs. If only one copy of this plate is to be used for all ponds, it should be properly <br />referenced by the as-built certification for each pond to which it applies, as far as where it (the <br />plate) can be found in the permit. <br />TCC submitted Plate 1 in the December 6, 1999 submittal, to incorporate into the permit. Plate <br />required labeling as DMG requested previously. The Plate needed additional information to <br />indicate that the Plate only applies to Ponds C and T, as stated in the cover letter. Plate 1 also <br />referenced other drawings (Energy Mines 1 and 2 Hydrology) which needed to be incorporated <br />into the Foidel Creek Mine permit. All submitted pages need to have the proper exhibit number <br />label. <br />TCC provided responses on January l5, 2000. Twentymile Coal Company provided a Label for <br />Plate 1 that indicates only the design for ponds C and T should be taken from it. Labels were <br />provided to place on Plate 1 to re-name it Exhibit 8P. Map 13, Energy Mines 1 and 2, was <br />referenced on Plate 1, and was provided with the January 15, 2000, for inclusion into the Foidel <br />Creek Mine Permit. <br />Twentymile Coal Company affixed labels to Plate 1 and Map 13, which resolved this concern. <br />i 62d) The Division's Mazch 2, 19981etter asked, <br />Pond E -Page 8-9? of Exhibit 8 disagrees with the Epp Stage-Storage diagram submitted and <br />approved as Figure 1 of Exhibit 8E. Information conflicts regarding the top of the primary riser. <br />The permit needs to clearly present the design information and the engineer is required to certify <br />C: W HB\C82056\RN03\020100resp. doc <br />
