That letter concerns the Water Quality Control Division's belief that certain
dischazge permit issues remain to be resolved. In that letter, Ms. Nelson states, with respect
to conversation with the Division of Minerals and Geology, the following:
"initial discussions with personnel from the State Division of Minerals and Geology
indicate that, from a geological perspective, there is a significant potential for drainage
from CC&V properties to enter the Roosevelt Tunnel," and
"similar discussions with the DMG indicate that flow may originate in the Roosevelt
Tunnel at a point further inside the mountain that [sic] what CC&V has indicated, and
it is possible that some hydraulic connection may exist between the flows that eventually
exit from the separate Carlton and Roosevelt Tunnels."
I would appreciate the opportunity to discuss with you this letter and its apparent reliance on
information attributed to Office of Mined Land Reclamation staff. As I have recently discussed
with Berhan Keffelew, it appears that the Water Quality Control Division paid little attention to
our eyewitness exploration of the Roosevelt Tunnel that documented the lack of flow in that
Tunnel between the Cresson Project mine area and the portal and the resulting source of
Roosevelt Tunnel flow from outside the Project area. That is information we submitted to the
Water Quality Control Division in January (with a copy to Mr. Keffelew).
The purpose of the meeting would be to assure that your staff has the information that the
Cripple Creek & Victor Gold Mining Company has generated and sent to the Water Quality
Control Division and to try to avoid future mis-communication with that Division. I have also
asked Dave Holm for a sepazate meeting to discuss the Water Quality Control Division's letter.
I will call you after you have an opportunity to be briefed to see if you have 30 minutes for a
review of this issue.
