Aggregate Source, M-77-193 / <br />Dear Mr. Klco: <br />The Division completed a technical review of your amendment application expanding [he permit <br />size to 231 acres. Following are several items which need to be addressed or revised in order to <br />meet the minimum requirements of the Act and/or the Mineral Rules: <br />A) Your recent submittal of a change of land ownership in the proposed amend<:d acreage (on <br />March 2, 2000) will require a change in the application form (page 2, paragraphs 6 and 7) <br />and a revision of Exhibit N (source of legal right to enter) and Exhibit O (owner of record) <br />to reflect the new ownership and Tezak's right to enter the lands for mining purposes. <br />B) Exhibit C -maps do not show the power lines in the northern portion of the Ixoposed <br />amended lands which were observed and discussed during the pre-operation inspection. <br />You need to revise the maps to include the structures. In addition, pursuant t~ Rule <br />6.4.3(8), you need to show the owner's name and the type of structure on thl; maps. <br />C) Exhibit D -Please provide information delineating the size of areas to be worked at any <br />one time. Currently, 55 acres of [he 95 acres is allowed to be disturbed, pursuant to <br />amendment #3. <br />D) The final sediment pond design should hold a minimum of 13 acre-feet (l0 ~~ear event) <br />prior to spillway operation. Also, the operator will be required to submit a certified as- <br />built drawing after construction of [he SWMP structure within 30 days after construction <br />is complete. <br />E) Will the existing diversion ditch from pond #l to pond #5 (across the pit floor) be <br />adversely affected by the newly proposed mining activities' If so, please describe how the <br />problem will be resolved (and when). If the ditch is not going to be affected please <br />describe how the structure will be avoided. <br />
