iii iiiiiiiiiiiuiii <br />Aggregate Industries <br />Brighton Mine; Permit M-1977-436 <br />Discussion Item before the MLRB <br />November 9, 2001 DMG conducts a routine inspection of the Brighton Mine. The North pit is approximately <br />65 feet from the South Platte River and river water seeping into the pit has created <br />instability in the pit slopes in terms of slumps and slides. <br />Item was noted as a problem in the inspection report, "The mining pit slopes in the Nortlt <br />Pond nppears to be unstnble due to the seeping of water from the South Platte River. <br />Several slides and sGtmps were observed within the pit area. 34-32.5-//6(4)(i) states thnt <br />areas outside of the affected (and shall be protected from slides or damnge occurring <br />during the mining and reclamation operations. <br />CORRECT/VE ACT/ON The operator shell submit a revision to the permit addressing <br />the stability of the north pit slopes in relation to the South Platte River. Such revision <br />shell contain measures to stabi4'ze the slope to ensure r/tnt the South Platte River is not <br />impacted. Such revision is due on lanunry 9, 2002. " <br />January 9, 2002 Aggregate Industries submits a Technical Revision (TR-04) to the Brighton Mine Permit. <br />Revision includes the following; <br />North Pi[ will be revised from a groundwater lake to a wetland habitat. Four feet of <br />berm separating the pit from the South Platte River will be removed to facilitate <br />floodwaters to enter and recede from [he pit. <br />Demonsvates that the North Pit was approved for dewalering to facilitate <br />reclamation. <br />• Provide riverbank protection specifications [o encroach within 200 fee[ and 100 feet <br />of the South Platte River in the Cenual and South Pits. <br />January 18, 2002 DMG informs Aggregate Industries that changes in reclamation plan must be submitted <br />as a Permit Amendment rather than a Technical Revision; <br />The definition of Amendment as described in the COnsVncllon Material Rules and Regulations <br />(Rule 1.1(6)) "means a change in the permit or an application which increases the acrenge of the <br />affected land, or which has a significant effect upon the approved or proposed reclamation plan." <br />The definition of Technical Revision as described in the Construction Material Rules and <br />Regulations (Rule 1.1(49)) "means a change in the permit on mt application, which does nor have <br />more than a minor effect upon the approved or proposed reclamation plan. " <br />• Aggregate Industries proposes to change the reclamation plan of the North lake from a <br />groundwater lake to constructed wetlands [hat allow Floodwaters to move through the area and <br />return to the river. The approved reclamation plan (Permit Amendment 2000) states that the <br />North Pi[ will be reclaimed to a groundwater lake with slopes no steeper than 3h:1 v. DMG <br />considers this a significant change to the reclamation plan. <br />The operator proposes to mine closer to the South Platte River which may increase the acreage of <br />affected land (2,500 lin.ft. pit along the river could disturb between I and 5 acres). <br />February 8, 2002 Aggregate Industries request the Division to reconsider filing [he changes as a Permit <br />Amendment. <br />February 11, 2002 Aggregate Industries extends the Division's decision date to February 22, 2002 and <br />request that this issue be scheduled for the February 20, 2002 MLRB Hearing [o discuss <br />if the changes in the reclamation plan can be filed as a Technical Revision rather than a <br />Permit Amendment. <br />February 18, 2002 DMG sends operator adequacy review regarding the technical issues surrounding [he <br />revised reclamation (to get the ball rolling). <br />
