1 <br />' (B) If Seller Is In Default. If Seller is in default, <br />Purchaser may elect to treat this contract as canceled, and all <br />' payments and things of value received hereunder shall be returned <br />to Purchaser. Alternatively, if all other conditions of this <br />contract have been met, Purchaser shall be entitled to specific <br />' performance. The return of payments and things of value or <br />specific performance are Purchaser's SOLE AND EXCLUSIVE REMEDIES, <br />and Purchaser expressly waives the remedy of additional money <br />' damages. <br />16. Earnest Money Dispute. Notwithstanding any termination <br />of this contract, Purchaser and Seller agree that, in the event of <br />' any controversy regarding earnest money and things of value held by <br />Reams, Reams & Coff, unless the parties mutually agree otherwise, <br />Reams, Reams & Coff shall not be required to take any action but <br />' may await any proceeding, or at their option and sole discretion, <br />may interplead all parties and deposit any moneys or things of <br />value into a court of competent jurisdiction and shall receive <br />' court costs and reasonable attorneys fees. <br />17. Inspection. Purchaser shall have the right to enter upon <br />the property and to perform testing to ascertain the suitability of <br />' the Property for gravel production. Included in this right, the <br />Purchaser shall be able to drill, excavate, bore and do whatever is <br />necessary for sufficient testing as required by Purchaser. <br />' Purchaser shall perform such tests in a manner that will minimize <br />surface disturbance to the Property and so as not to disturb <br />existing buildings and improvements. <br />Purchaser shall have thirty (30) days from the date this <br />' contract is signed and returned to Purchaser to perform testing. <br />All testing shall be at Purchaser's sole expense. In the event <br />Purchaser finds the test results unsatisfactory, then Purchaser <br />' shall notify Seller in writing of its intent to rescind this <br />contract and all earnest monies shall be returned to Purchaser. <br />Said notice of Purchaser's decision to rescind this contract shall <br />' be made to Seller within the thirty (30) day period provided for <br />testing. Subject to Purchaser's voluntary waiver of this <br />contingency, Purchaser's obligations hereunder are expressly <br />contingent upon Purchaser obtaining satisfactory test results. <br />1 Purchaser assumes all risk of injury or damage to person or <br />property caused by or in any way related to any drilling, boring, <br />' excavating or other activities undertaken by Purchaser in <br />connection with Purchaser's testing, and Purchaser agrees to <br />indemnify and hold Seller harmless from any and all suits, demands, <br />' claims or controversies that ,may result therefrom. <br />If Purchaser gives notice of its intent to rescind based upon <br />unsatisfactory test results within thirty (30) days as provided <br />' 6 <br /> <br />
