<br />t <br />(C) Right To Cure. If Seller receives notice of <br />' unmerchantability or any other unsatisfactory title condition as <br />provided in subsection (a) or (b) above, Seller shall use <br />reasonable effort to correct said unsatisfactory title conditions <br />prior to the date of closing. If Seller fails to correct said <br />' unsatisfactory title conditions on or before the date of closing, <br />this contract shall then terminate, subject to Section 16, <br />provided, however, that Purchaser may, by written notice delivered <br />to Seller on or before the date of closing, waive any objections to <br />'_ said unsatisfactory title conditions. <br />8. Date of Closing. The date of closing shall be March 15, <br />' 1994, plus any extension thereof in accordance with this contract, <br />or by mutual agreement at an earlier date. The hour and place of <br />closing shall be as designated by Abstract & Title'Company of Mesa <br />' County, Inc., 205 North 4th, Grand Junction, Colorado. <br />9. Transfer of Title. Subject to tender of payment at <br />closing as required herein and compliance by Purchaser with the <br />other terms and conditions hereof, Seller shall execute and deliver <br />a good and sufficient Special Warranty Deed, conveying the Property <br />free and clear of all taxes except the general taxes for year of <br />closing; free and clear of all liens for special improvements <br />installed as of the date of Purchaser's signatures herein, whether <br />assessed or not; except distribution utility easements, including <br />' cable TV; except those matters reflected by the Title Documents <br />accepted by Purchaser in accordance with subsection 7(a); except <br />those rights, if any of third parties in the property not shown by <br />' the public records in accordance with subsection 7(b), and subject <br />to building and zoning regulations and existing as well as recorded <br />easements, rights-of-way and mineral patent limitations. <br />' 10. Payment of Encumbrances. Any encumbrances required to be <br />paid shall be paid at or before the time of closing from the <br />proceeds of this transaction or from any other source. <br />11. Closing Costs, Documents and Services. Purchaser and <br />' Seller shall pay their respective closing costs at closing, except <br />as otherwise provided herein. Purchaser and Seller shall sign and <br />complete all customary or required documents at or before closing. <br />Fees for real estate closing and settlement services shall not <br />' exceed $300.00, and shall be shared equally by Seller and <br />Purchaser. <br />' 12. Prorations. General taxes for the year of closing, based <br />on the most recent levy and the most recent assessment, rents, <br />water and sewer charges, owner's associations dues, and interest on <br />4 <br /> <br />
