This operation <br />is known as Amendment 1 to Construction Materials Reclamation Permit M-1977-020 or <br />more informally, the Black Pit. <br />To recapitulate our conversation on Saturday May 5, 2001, we discussed two main areas. <br />1. You told me that you wanted to increase the height of the barrier berm located <br />at the south and west sides of the Black Pit. Your reason for wanting to increase <br />the berm height was to increase the barrier effect of the berm. A new Safeway <br />store has been built on the other side of Highway 92 and you anticipate <br />increased light from the store and parking lot. A higher berm will provide a <br />better visual barrier for your property. In addition, noise from the highway and <br />railroad would be blocked more effectively by a higher berm. <br />When I described the encroachment issue in the 50 foot wide buffer zone at the <br />North side of the Amendment 1 (Black Pit) area, you were surprised that the <br />buffer was 50 feet wide at this boundary. Your understanding was Chat it was a <br />twenty five (25) foot wide buffer z ne. Would you agree to a 25 foot buffer <br />zone at this boundary? _~S 4UiJt <br />Another aspect of the situation at the north boundary of Amendment 1 is that <br />you mentioned that you had applied for a bank loan to purchase the Loughery <br />property that is the subject of Amendment 2 for this Reclamation Permit.
