MINED LAND RECL~4MATION BOARD' ~ ! ~'`~~ <br />DEPARTMENT OF NATURAL RESOURCES' ~- '~ ~~ ~~ <br />STATE OF COLORADO <br />In The Matter Of: ] Affirmation of The <br />Rockcastle Coal Company ] Mined Land Reclamation Division's ~L <br />Grassy Gap Mine ] Decision to Deny ~~ ~!~ <br />Permit Renewal ] Mining Permit No. C-81-039 w <br />This matter was presented at a hearing before the Mined Land Reclamation Board <br />(hereinafter "Board) on May 24, 1990, in Room 220 of the Centennial Building <br />at 1313 Sherman Street, Denver, Colorado, pursuant to the Colorado Surface <br />Coal Mining Reclamation Act, Section 34-32-101 et seq. The Board conducted <br />the hearing following twenty days public notice~o consider the Colorado Mined <br />Land Reclamation Division's ("Division") recommendation that the permit <br />renewal be denied. Also under consideration was bond forfeiture. <br />Board Members Dennis H. Donald, Catherine Kraeger-Rovey, James B. Cooley, <br />Chris P. Jouflas and Terrence Lee O'Connor were present. Chairperson <br />Catherine Kraeger-Rovey presided over the hearing. The hearing was held in <br />accordance with C.R.S. 34-33-109(7) and 2 CCR 401-2 Rules 2.08.5(3) and 3.04. <br />Pursuant to the authority vested in the Board by 2.08.5(3)(a) the Board hereby <br />makes the following Findings of Fact, Conclusions of Law and Board Order. <br />
