LIST OF STIPULATIONS Three stipulations have been attached to the approval of this permit term. Two of the stipulations have been carried over from the previous permit term approval, and stipulation No. 20 is new. Five of the stipulations attached to the approval of the past permit term have been terminated. The following is a list of stipulations and their status. The numbering used in this findings is the numbering used on the Division's computer. Numbers are assigned sequentially and will not be used again after they are terminated. The numbering used during the last issuance of the findings is bracketed. The following stipulation is new and applies to the approval of this permit term. STIPULATION NO. 20 KERR COAL COMPANY WILL CONTINUE TO WORK WITH THE DIVISION TO ESTABLISH THE RECLAMATION LIABILITY AMOUNT. WHEN AN AMOUNT IS AGREED UPON, THIS AMOUNT WILL BE SUBMITTED AS A NEW BOND OR RIDER TO THE EXISTING BOND (PURSUANT TO RULE 3.02). The following stipulations have been carried through into the next permit term. STIPULATION NO. 13 (listed as No. 1 during second permit term renewal) KERR COAL IS REQUIRED TO CONSTRUCT ALL DITCHES USING THE DESIGN GRADES RATHER THAN THE GRADES SHOWN ON MAP 16A. IF THIS REQUIRES RELOCATING ANY DITCHES FROM THE LOCATION SHOWN OH THE MAP, THEN A REVISED MAP 16A MUST BE SUBMITTED AT THAT TIME. STATUS: Kerr Coal is in compliance with this stipulation. This map has been revised since the issuance of this stipulation but discrepancies still exist so this stipulation still applies to the approval of this renewal. STIPULATION NO. 16, (listed as No. Rl during second permit term renewal) THE PERMITTEE IS REQUIRED TO SUBMIT TO THE DIVISION A YEARLY REPORT ON THE PROGRESS OF ALL HYDROLOGICAL MONITORING WHICH INCLUDES ALL DATA COLLECTED FOR THAT YEAR AND A DISCUSSION ON ANY CONCLUSIONS WHICH CAN BE DRAWN FROM THE DATA.
