original stream channel will be restored, water quality and quantity shall <br />not be adversely affected, and appropriate riparian vegetation will be <br />reestablished. The buffer zone variance is granted to haul roads that <br />cross these riparian areas that are located adjacent to the haul roads <br />between Pits 1 and 2 and between Pits 2 and 3 (application pages 816-83, <br />volume 2, Rule 4.05.180)). <br />II. <br />Topsoil <br />1. If Pit 2 is not opened, where Kerr had anticipated getting additional topsoil from <br />the mining in the Pit 2 area, topsoil will be placed at a minimum depth of .5 feet <br />(page 816-126). If Pit 2 is mined additional topsoil will be available, Kerr has <br />committed topsoiling to depths ranging from .5 to 2,99 feet (starts on page 816- <br />21 and page 816-125, volume 2 of permit app]ication). <br />2. If mining progresses beyond Pit 1, The Division has determined that the B <br />horizon and portions of the C horizon shall be segregated and replaced as <br />subsoil in order to ensure soil productivity consistent with the approved <br />post-mining land use [4.06.2(3)]. Subsoils from Pit 3 will be placed on Pits 1 and <br />2 prior to topsoil placement to ensure adeyuate depths of non-sodic plant growth <br />medium. <br />Ili. <br />Sealing of Drilled Holes and Underground Openings <br />1. The Division will require that each hole, well or other underground opening be <br />capped, sealed, backfilled, or otherwise properly managed. (4.07.3). <br />IV. <br />Use of Explosives <br />1. The Division proposes to approve blasting at times other than those described in <br />the blasting schedule due to unavoidable hazardous situations. (permit <br />application page 816-85 ffffff, Rule 4.08.3(2)(b)(v) and (4.08.4(2)). <br />V. <br />Bacl:tilling and Grading <br />1. The applicant has requested additional time for backfilling and grading following <br />coal removal. Because this mine is an area mine the pit must be excavated <br />before backfilling can begin. A detailed written analysis under 2.05.4(2)(c) has <br />demonstrated that additional time is necessary. Therefore, the Division proposes <br />Marr Strip Mine, C-80-006 <br />22 <br />December 9, 1992 <br />
