Specific approvals required under Rule 4 have been granted or are proposed. These <br />approvals are addressed in the following section, Section B. (2.07.6(2)(m)). <br />15. The Division finds that the activities proposed by the applicant would not affect the <br />continued existence of endangered or threatened species or result in the destruction or <br />adverse modification of their critical habitats. (2.07.6(2)(n)). <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As <br />of this time, November 30, 1992, the operator is current in the payment of reclamation <br />fees required by 30 CFR Chapter VII, subchapter R. (2.07.6(2)(0)). <br />SECTION B <br />The following findings and specific approvals are required by Rule 4 <br />I. Hydrologic Balance -Rule 4.05 <br />A. Surface and Groundwater Monitoring <br />The water monitoring program is described on pages 780.107 6b through 780-110 <br />of Volume 2. This plan is organized into four phases of monitoring <br />corresponding to disturbance at the site. <br />1. The groundwater monitoring plan is as follows: (4.05.13(1)). <br />Monitoring of wells completed in the alluvium, overburden and coal <br />aquifers are monitored for water level, field parameters and major cations <br />and anions on a quarterly basis except for the winter quarter. Alluvial <br />wells in the Kerr mine area are measured on a monthly basis during <br />March through October, while at the loadout they are measured weekly <br />during March through June and monthly during July through October. In <br />addition, trace metal analyses are performed on alluvial well samples <br />during the spring and fall and on an annual basis for bedrock samples. In <br />the future, three additional wells will be installed in the pits as they are <br />backfilled to monitor the establishment of a spoils aquifer. <br />Marr Strip Mine, C-80-006 20 December 9, 1992 <br />
