This Plan summarized the data and analyses conducted
to date to characterize the elevated total dissolved solids (TDS) levels previously
identified in monitoring well M-1 I R and the response measures, including interim
containment, which have been implemented by BMRI. The Plan also sets forthithe
technical studies BMRI believes aze necessary to fully characterize the surrounding
hydrogeology in sufficient detail to allow the evaluation and design of long tern[ response
measures and establishes a schedule for their implementation.
BivIRI would like to propose that an item be sciredukd on the agcuda fur the
December Boazd meeting to allow BMRI and the Division to make a presen[a[ign
regarding the current understanding of the nature of the TDS problem, the interim
response measures in place at the site, and the schedule and approach outlined in the
Response Plan for long term response measures. As we have discussed, it is BMRI's
preference that the Response Plan be incorporated into an enforceable compliance order
and we therefore waive the required notice period as necessary to accommodate a formal
public hearing to consider and approve a mutually agreeable order.
In this regazd, we would request that we commence discussions regarding the
possible terms of such an order as well as working out any differences of opinion
regarding the elements of the Response Plan as soon as possible.
