Box 42 <br />Gunnison, CO 81230 <br />Re: Dickerson Pit, Revision Approval, Permit No. M-78-305, Revision No. TR-002 <br />Dear Mr. Wilcox: <br />On January 08, 1993 the Division of Minerals and Geology conditionally approved the <br />technical revision application submitted to the Division on November 10, 1992, <br />addressing the change to a non-phased mine plan. The terms of the TR No. 002 <br />approved by the Division are hereby incorporated into Permit No. M-78-305. <br />The conditions of the Board approval are noted below. Please note that all other <br />provisions of Permit No. M-78-305 remain in full force and effect. <br />Stipulation No. O1 <br />THE OPERATOR WILL SUBMIT A REPLACEMENT BOND, OR A RIDER TO THE EXISTING BOND, <br />TO BRING THE TOTAL AMOUNT OF FINANCIAL WARRANTY TO $13,300.00. THIS SUBMITTAL <br />MUST BE MADE PRIOR TO MARCH 5, 1993. <br />Stipulation No. 02 <br />SECURE AN AGREEMENT WITH THE UTILITY CONTROLLING THE POWER LINE RUNNING THROUGH <br />THE SITE THAT ANY DAMAGES TO THE POWER LINE RESULTING FROM MINE OPERATIONS <br />WOULD BE COMPENSATED FOR. SUBMIT DOCUMENTATION THAT SUCH AN AGREEMENT IS IN <br />PLACE BY MARCH 5, 1993. <br />Stipulation No. 03 <br />IMPLEMENT MEASURES TO CONTROL STORM WATER AND RUN-OFF AT THE PIT AS DETAILED IN <br />THE ADEQUACY DOCUMENTS FOR THIS REVISION. <br />If you have any questions, please contact me. <br />Sincerely, <br />Allen C.
